In this Privacy Policy, we describe how we collect, use, and disclose information that we obtain about users of our website eossar.com (the “Site”) and the services available through our Site (collectively, the Site, and the services available through it, are the “Services”).
By using any of our Services, you agree that any information that we collect from or about you through our Services, including personal information, anonymous information, and aggregate information, will be handled as described in this Privacy Policy.
Your use of our Services, and any dispute over privacy, is subject to this Privacy Policy and any other applicable agreements between you and EOSSAR, such as our Terms of Use, including any applicable limitations on damages and the resolution of disputes.
Where the use of specific EOSSAR Services requires the processing of personal data, users will be requested and required to give express prior consent to the processing of their personal data by EOSSAR when making use of the Service subject to Data Protection Law.
Data Protection Law means (i) Regulation (EU) 2016/679 ("GDPR" or "RODO"), (ii) the Polish Act of 10 May 2018 on the Protection of Personal Data (as amended or replaced from time to time), and (iii) any other applicable legislation implementing or supplementing the GDPR or other law relating to the processing of Personal Data of natural persons in the jurisdictions where the Services are provided (e.g., CCPA/CPRA).

We automatically collect information about you through your use of our Services, including, without limitation:
- Log information, such as your Internet protocol (IP) address, the type of browser you are using, information about the device you are using, domain name, the website that led you to our Services, the website to which you go after leaving our Services, your location, and the dates and times you access our Services.
- Usage information, such as numbers of the scenes viewed by user, the combination of bands selected or used by user, and the types of analytics or algorithms a user applies.

How We Use Your Information
We may use your information, including personal information, for the following purposes:
- Providing and Improving Our Services. To provide and maintain our Services; to improve our Services; to develop new features, products, or services; to authenticate users; to perform technical operations, such as updating software; to validate our users and ensure their qualifications to use our Services; and for other customer service and support purposes.
- Marketing and Communications. To communicate with you about your use of our Services, including providing you with product updates; to respond to your inquiries; to provide you with news and newsletters, special offers, promotions, and other information we think may interest you; and for other informational, marketing, or promotional purposes. - Legal Compliance. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
In carrying out these purposes, we combine data we collect to give you a more personalized experience. However, to enhance privacy, we have built in technological and procedural safeguards designed to prevent certain data combinations.
How We Disclose Your Information
We may disclose your information, including personal information, as described to you at the time of collection or disclosure or as follows:

We share your personal data with your consent or as necessary to complete any transaction or provide any product you have requested or authorized.
In addition, we share personal data among EOSSAR-controlled affiliates and subsidiaries. We also share personal data with vendors or agents working on our behalf for the purposes described in this statement. For example, companies we've hired to provide customer service support or assist in protecting and securing our systems and services may need access to personal data to provide those functions. In such cases, these companies must abide by our data privacy and security requirements and are not allowed to use personal data they receive from us for any other purpose. We may also disclose personal data as part of a corporate transaction such as a merger or sale of assets.
Finally, we will access, transfer, disclose, and preserve personal data, when we have a good faith belief that doing so is necessary to:
- comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies;
- protect our customers, for example to prevent spam or attempts to defraud users of our products, or to help prevent the loss of life or serious injury of anyone;
- operate and maintain the security of our products, including to prevent or stop an attack on our computer systems or networks;
Please note that some of our products may include links to products of third parties whose privacy practices differ from EOSSAR's. If you provide personal data to any of those products, your data is governed by their privacy statements.
Data Retention and Correctness
EOSSAR retains the data collected pursuant to this Privacy Policy for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. EOSSAR does not verify the correctness of personal data.
Irrespective of the above, EOSSAR may still retain some of the data to the extent such retention is necessary to resolve disputes, enforce EOSSAR user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of Services.
Third-Party Analytics
We may use third-party analytics companies, such as Google Analytics, to evaluate use of our Services. We or our service providers use these tools to help us understand use of, and to improve, our Services, performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services.
When we use Google Analytics we may share your information with Google Analytics to track and analyze the use of the Services. Third-Party Links
Our Services may contain links to third-party websites and applications. Any access to and use of such linked websites and applications is not governed by this Privacy Policy but instead is governed by the privacy policies of those third parties. We are not responsible for the information practices of such third-party websites or applications.
How to Access and Control Your Personal Data
How you can access or control your personal data will depend on which products you use. You can always contact EOSSAR by info@eossar.com. We will respond to requests to access or delete your personal data within time required by applicable laws.
Security
We have taken steps to help protect the personal information we collect. However, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your device and account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
Limitation of Liability. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL EOSSAR (OR ITS LICENSOR(S) OR SUPPLIER(S)) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO EOSSAR IN CONNECTION WITH THE SERVICES IN THE THREE (3) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL. NOTWITHSTANDING THE FOREGOING, THIS LIMITATION SHALL ONLY APPLY TO THE EXTENT IT DOES NOT GROSSLY VIOLATE STATUTORY CONSUMER RIGHTS OF INDIVIDUALS.

Opting out of Marketing Emails. We may send periodic promotional emails to you. You may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us.
U.S. State Privacy Rights.
This section applies only to individuals who are residents of U.S. states that have enacted comprehensive consumer privacy laws and only to the extent such laws are applicable to our processing activities (“Applicable State Privacy Laws”).
Privacy rights, definitions, response timelines, and verification requirements vary by state and may be subject to statutory thresholds, exemptions, and exceptions. We will honor consumer rights solely as required by applicable law and do not voluntarily extend rights where not legally mandated.
California “Shine the Light” Disclosure.
Pursuant to California Civil Code Section 1798.83, California residents may request, once per calendar year and free of charge, information regarding the categories of personal information (if any) disclosed to third parties for their direct marketing purposes and the names and addresses of such third parties during the immediately preceding calendar year. This disclosure applies only to California residents. For purposes of the California Consumer Privacy Act and related regulations, a “resident” means:
an individual who is in the State of California for other than a temporary or transitory purpose; or
an individual domiciled in California who is outside the State for a temporary or transitory purpose.
For residents of other U.S. states, we apply the definitions set forth in the Applicable State Privacy Law.
Consumer Rights (Where and to the extent required by law)
Subject to Applicable State Privacy Laws, and only where legally required, you may have the right to:
Request access / disclosure;
Request confirmation as to whether we process your personal information and, where applicable, receive information regarding:
- categories of personal information processed;
- purposes of processing;
- categories of third parties with whom information is shared; and
- specific pieces of personal information, where required by law.

Non-Discrimination.We will not unlawfully discriminate against you for exercising rights granted by Applicable State Privacy Laws.
Sensitive Personal Information. We do not collect or process sensitive personal information as defined under Applicable State Privacy Laws in a manner that would require consumer opt-out or limitation rights.
We do not sell personal data to third parties or process personal data for targeted advertising.
We do not knowingly collect, use, or otherwise process personal information of children, as defined under applicable law, including children under the age of 13, and our Services are not directed to children.
Authorized Agents. Where required by law, you may designate an authorized agent to submit a request on your behalf. We may deny requests from agents who fail to provide legally sufficient proof of authorization.
Household Data. We do not collect or process household-level personal information. Any requests received will be treated as individual consumer requests.
Verification of Requests. We reserve the right to verify your identity before responding to any request. Verification methods may vary depending on the request and applicable law.
Information provided for verification purposes will be used solely to verify identity, authority, and to prevent fraud. If we cannot verify your request using information already in our possession, we may deny the request or request additional information as permitted by law.

Children
Our Services are not targeted to children under eighteen (18) years of age and we do not knowingly collect personal information from children under 18. If we discover that a child under 18 has provided us with personal information, we will promptly delete such personal information from our systems. If you believe we have collected personal information from a child under 18, please contact us immediately.
Miscellaneous
EOSSAR may store and/or transfer your personal data to its affiliates and partners in and outside of EU/EEA member states and the United States in accordance with mandatory legislation and this Privacy Policy.

The Terms and the relationship between you and us will be governed by the laws of Poland, without giving effect to principles of conflict of laws of any jurisdiction.
